Qantas Wine Terms and Conditions

Effective 30 April 2024

These Qantas Wine Terms are effective from the date of publication shown above and may be amended from time to time.

By using the Website, setting up a Member Account, applying for Premium Membership or making any purchase of Products on the Website, you agree to be bound by these Qantas Wine Terms (as amended from time to time). These Qantas Wine Terms create a contract between you and Qantas Wine.

1. Definitions

In these Qantas Wine Terms, unless the context otherwise requires:

Accepted Payment Card means a VISA, MasterCard, American Express, ApplePay or charge card which a Member uses to make a payment to Qantas Wine, or such other form of card payment as approved by Qantas Wine from time to time.

Benefits means any of the goods, services, discounts, offers or arrangements offered or made available to Members from time to time by Qantas Wine or Qantas as a result of Premium Membership.

Bonus Points means bonus or additional Points awarded to Members in addition to any applicable Points per dollar spent.

Change of Mind Return has the meaning given to that term in clause 15.1.

Consequential Loss means any loss of profits, loss of revenue, loss of opportunity or any other indirect loss.

Coupon Codes or Special Offers means any promotional codes or special offers that offer a discount on the total price of a Product or Event, or other benefit, that are communicated to Members through email, mail or any other communication channel.

Damaged Goods Return has the meaning given to the term in clause 15.1.

Eligible Product has the meaning given to that term in clause 10.1(a).

Eligible Purchase means the purchase of Products by a Member in accordance with these Qantas Wine Terms. 

Eligible QFF Member means a member of the QFF Program (who is not a Premium Member) who is over 18 years of age and has an Australian delivery address.

Event means any event or promotion which is advertised on the Website or is otherwise communicated to Members through email or mail marketing communication, for which Qantas Wine offers tickets (Event Tickets) to Members.

Event Tickets has the meaning given to that term in the definition of Event. 

GST means any goods and services tax, value added tax or sales tax imposed on the sale or supply of goods, services and rights including but not limited to a tax imposed by the A New Tax System (Goods and Services Tax) Act 1999 (Cth) and the related imposition Acts of the Commonwealth. 

Including means including without limitation.

Losses means all liabilities, losses, damages, costs and expenses.

Member means an Eligible QFF Member or a Premium Member (as the case may be) who has or is proposing to transact on the Website.

Member Account has the meaning given in clause 3.1.

Non-Excludable Terms has the meaning given to that term in clause 21.1.

Order means an order for Products placed in accordance with clause 7.

Points means points in the QFF Program.

Premium Member means a natural person who holds a Premium Membership.

Premium Membership means the membership made available by Qantas Wine in accordance with clause 4 and referred to by Qantas Wine as ‘Premium Membership’.

Premium Membership Special Offer has the meaning given to that term in clause 4.2.

Products means all goods and services offered for sale by Qantas Wine from time to time on the Website.

Qantas means Qantas Airways Limited (ABN 16 009 661 901).

Qantas Group means Qantas and its related bodies corporate, as defined in the Corporations Act 2001 (Cth), including Qantas Wine.

Qantas Group Company means a company in the Qantas Group from time to time.

Qantas Wine means Qantas Frequent Flyer Operations Pty Limited (ABN 22 132484 210).

Qantas Wine Business means the business known as ‘Qantas Wine’ (or any replacement name) which is operated by Qantas Wine.

Qantas Wine Terms means these terms and conditions.

QFF Member means a natural person who is a member of the QFF Program.

QFF Membership means membership of the QFF Program.

QFF Program means the loyalty program currently known as the Qantas Frequent Flyer program, which is operated by or on behalf of Qantas.

QFF Terms means the terms and conditions of the QFF Program, as amended from time to time.

Service Centre means the service centre for the Qantas Wine Business, which can be accessed by telephoning - 1800 505 004 Monday to Saturday (excluding national public holidays in Australia) between 8am – 7pm AEST/AEDT.

Special Offers see the definition of Coupon Codes.

Subscription Products means Products which are available to a Member as pre-arranged periodic deliveries over a period of time as selected by that Member and confirmed in the Member’s Order. 

Supplier means any person or company contracted by Qantas Wine or Qantas from time to time to provide services in connection with the Qantas Wine Business or Membership, including but not limited to the delivery or supply of Benefits or Products.

Third Party Products means goods or services acquired from third parties as described in clause 21.2.

Website means www.qantas.com/wine.

2. Responsible Service of Alcohol

2.1 It is against the law to sell or supply alcohol to, or to obtain alcohol for or on behalf of, a person under the age of 18 years.

2.2 By ordering alcohol or liquor Products, the Member warrants that:

(a) the Member is 18 years of age or older;

(b) any person that the Member is obtaining the Products for, or supplying the Products to, is 18 years of age or older; and

(c) any person that is receiving the alcohol or liquor Products at the specified delivery address is 18 years of age or older.

2.3 It is a condition of purchase that the Member making the purchase verifies that they are 18 years of age or over and that all the details provided in the Order are true and correct. If a Member does not confirm that they are 18 years or over, their Order will not be processed.

2.4 Qantas Wine may cancel any Order, or refuse to supply Products, if it is not reasonably satisfied that the requirements in clause 2.2 are satisfied, or if Qantas Wine otherwise reasonably considers that the supply would breach any laws or regulations applicable to supply of liquor.

3. Member Account

3.1 The Website offers an ‘Account’ facility to all Members (Member Account) which can be used to view and edit information, order history, order status’ and perform certain functions, relating to their Account.

3.2 Each Member must advise Qantas Wine of any changes of name, address, email, phone or other Member Account information as soon as practicable after the change by updating the information via the Website or by contacting the Service Centre.

3.3 Qantas Wine is not responsible for any loss, damage or claims which are caused by the Member’s failure to update or provide accurate information in accordance with this clause 3.

3.4 Updates made to the Member Account will not be transferred to the Member’s QFF Membership account and the Member must update his or her QFF Membership account separately.

4. Premium Membership

4.1 Eligibility

(a) A person is only eligible to be a Premium Member if he or she is a QFF Member and is 18 years of age or older.

(b) Premium Membership will terminate automatically on the death of a Premium Member.

4.2 Issue of Premium Membership

(a) Premium Memberships are currently only being issued on a complimentary basis through special offers by Qantas Wine, Qantas or participating third party partners of Qantas (Premium Membership Special Offers).  Other applications for a Premium Membership are currently not being accepted.

(b) Qantas Wine may limit the number of Premium Members from time to time.

(c) Any Member who holds a Subscription Product that has not been cancelled will be entitled to Premium Membership.

4.3 Cancellation of Premium Membership

(a) A Premium Member may request cancellation of their Premium Membership at any time by contacting the Service Centre. Qantas Wine will action such requests within 30 days.

(b) If a Member's entitlement to Premium Membership ends, under the terms of any Premium Membership Special Offer or under clause 4.3(c), Qantas Wine may cancel the Premium Membership. 

(c) If Qantas Wine has reasonable grounds to suspect that a Premium Member is not eligible for Premium Membership, has committed a material breach of these Qantas Wine Terms or has failed to pay any money due to any Qantas Group Company, whether intentionally or otherwise, then Qantas Wine may cancel that Member’s Premium Membership.

(d) If Qantas Wine intends to take action under clause 4(c), it will notify the Premium Member of its intention and the reason for that action. The Premium Member will then have 14 days to respond to this notice by rectifying the breach (where possible) and providing any reason why Qantas Wine should not take action (provided that Qantas Wine may suspend Premium Membership until any review is completed). Qantas Wine will review the response and advise the Premium Member of its decision.

(e) In addition to the rights above, if Qantas Wine decides to terminate the Premium Membership offering, Qantas Wine may terminate the Premium Membership of any Premium Member by giving reasonable prior notice to the Premium Member where practicable.

4.4 Premium Membership is personal

Each Premium Membership is personal and non-transferable. Premium Members must not:

(a) permit third parties that are not Premium Members to access Benefits; or

(b) permit any person to access their Member Account.

4.5 Benefits

(a) Qantas Wine may from time to time modify, add or remove Benefits at its absolute discretion. Qantas Wine will advise Premium Members of any material changes to the Benefits by publishing the changes on the Website.

(b) It is the responsibility of Premium Members to ensure they are familiar with the available Benefits, including changes to Benefits, by visiting the Website.

4.6 Points Club Members

Points Club members will receive complimentary Qantas Wine Premium membership for the duration of their Points Club membership. Points Club Plus members will receive complimentary Qantas Wine Premium membership, plus an additional 10% discount on marked prices at Qantas Wine on all products, excluding Penfolds, for the duration of their Points Club Plus membership. 10% discount will be applied at checkout and cannot be used in conjunction with any other promotional offer or voucher code, except for the Points Club Plus birthday vouchers. Vouchers will be in My account when you attain or retain Points Club or Points Club Plus. 5. Products

5.1 Qantas Wine will use reasonable endeavours to ensure that all Products that are displayed for sale on the Website are available for purchase. If a Product is ordered but is not available, Qantas Wine and Qantas will either (in Qantas Wine's discretion):

(a) endeavour to supply a substitute Product of equivalent value or:

(b) refund the amount paid for the Product by the Member by either crediting that Member’s QFF Program account for the Points redeemed, or crediting the Accepted Payment Card used, to purchase the Product, or both, as the case may be and deduct the number of Points credited to the Member’s QFF Program account in connection with the purchase of payment of the applicable Product.

5.2 Qantas Wine may at any time, without advance notice to Members withdraw, limit, modify, or cancel the availability of a Product, or modify the amount payable for or Points required to redeem for Products (as applicable). Products are strictly limited in number, may be offered for a limited time and are offered while stocks last. Qantas Wine may also restrict or limit the quantity of Products available for purchase in Qantas Wine's absolute discretion.  

5.3 Bonus points available on selected cases only. The selected cases can change at any time.

5.4 All wine brands in the Sustainable Sips program hold Sustainable Winegrowing Australia Certification. Certified wineries have been independently audited against the Australian wine industry sustainability standard. While this means that practices within the winery meet the industry sustainability standard, there is no guarantee that all grapes used to make the wine have been sourced from a certified sustainable vineyard.

6. Subscription Products

6.1 Purchase of Subscription Products

By purchasing a Subscription Product, the Member consents to:

(a) Qantas Wine storing the Member’s payment information, either directly or through a third-party payment provider, to allow for payment of the required instalments; and

(b) Qantas Wine initiating payment for the agreed instalments with the Member’s nominated default payment method for the duration of the Subscription Product, unless the Member otherwise cancels their Subscription Product in accordance with these terms.

6.2 Cancellation of Subscription Products

(a) If a Member has purchased a Subscription Product and notified Qantas Wine that they wish to cancel that Subscription Product, Qantas Wine and Qantas will:

(i) cancel all scheduled direct debits for that Subscription Product;

(ii) refund any payment taken by Qantas Wine for Subscription Products not yet dispatched by Qantas Wine by either crediting that Member’s QFF Program account for the Points redeemed, or crediting the Accepted Payment Card used to pay for the Subscription Product, or both, as the case may be; and

(iii) deduct the number of Points credited to the Member’s QFF Program account in connection with the purchase of any undelivered Subscription Products.

(b) Orders for Subscription Products can be cancelled or modified until the relevant cut-off date specified by Qantas Wine in its notification which is sent to the Member prior to dispatching each periodic delivery of Subscription Products.

6.3 Suspension of Subscription Products

(a) If a Member has purchased a Subscription Product and that Member notifies Qantas Wine prior to the cut-off date referred to in clause 6.2(b) in accordance with the terms of the applicable the Subscription Product that they wish to cancel the next scheduled delivery or deliveries, but not cancel the Subscription Product entirely, that request shall be treated as a “suspension” of the Subscription Product. Qantas Wine will not make any further debits from the Member’s account and will not make any further deliveries in respect of the suspended Subscription Product until receiving further notice from the Member, or until the period of time requested by the Member has lapsed.

(b) If Qantas Wine is unable to debit the purchase price for any periodic delivery of the Subscription Product from an Accepted Payment Card stored on the Member Account (including due to the stored card having expired or been cancelled or suspended, or there being insufficient funds in the card account, or due to Accepted Payment Card details having been deleted from the Member Account), then Qantas Wine will suspend the Subscription Product and notify the Member of the suspension. Qantas Wine will not attempt to make any further debits from the Accepted Payment Card for the suspended Subscription Product and will not make any further deliveries of the suspended Subscription Product, until the Member provides Qantas Wine with updated payment information by contacting the Service Centre.

6.4 Bonus Points

Members who have a Wine Subscription will earn bonus points if they retain the same Wine Subscription for four consecutive orders of the same case. Bonus points are contingent on the nominated Wine Subscription plan. Points will be credited to the member's Qantas Frequent Flyer account within 6 weeks of the final order delivery date.

7. Ordering

7.1 Your contract for the purchase of liquor Products is with Qantas Wine, holder of liquor licence numbers NSW LIQP770016736, NT IRL0201, SA 57900154 attached to premises at 10 Bourke Road, Mascot NSW 2020 (the Licensed Premises).

7.2 The sale of liquor pursuant to the offer to purchase from the Website is made at our Licensed Premises.  All Orders are subject to acceptance by Qantas Wine at the Licensed Premises, certification and evidence of you being over 18 years of age, and the availability of stock specified in the Order. 

7.3 Qantas Wine will only accept orders for Products from current Eligible QFF Members. Members may purchase Products by placing orders for those Products using the ordering process available on the Website (Order). Products are not for resale or resupply.

7.4 Qantas Wine may reject an Order, acting reasonably : 

(a) if Qantas Wine reasonably believes the Member has placed the Order for the purposes of reselling or resupplying Products; 

(b) if Qantas Wine is not able to deliver the Order due to circumstances outside of its reasonable control (including, for example, where the delivery address cannot be safely accessed); or

(c)  in the other circumstances outlined in these Qantas Wine Terms.

7.5 If any Product is listed with the incorrect price, quantity of included items, and/or number of Points that may be earned in connection with acquisition of that Product, and Qantas Wine reasonably considers that the mistake should have been obvious to Members acting reasonably, then Qantas Wine and Qantas may cancel any Order placed by a Member for the Product and:

(a) refund the amount paid for the Product by the Member by either crediting that Member’s QFF Program account for the Points redeemed, or crediting the Accepted Payment Card used, or both, as the case may be; and

(b) deduct the number of Points credited to the Member’s QFF Program account in connection with the purchase of the Product.

7.6 Orders for Products that are not Subscription Products cannot be cancelled or modified after that Order has been received and processed by Qantas Wine and/or the Supplier.

8. Price and payment

8.1 The money amount payable and Points required to be redeemed to obtain a Product will be displayed on the Website and may be varied prior to purchasing the Products without advance notice to Members. All prices displayed on the Website are in Australian dollars and include Goods & Services Tax (GST) where applicable.

8.2 The Products specified in an Order will not be dispatched until the payment from the Accepted Payment Card has been authorised by the relevant merchant bank or Qantas Wine has confirmed that the Member has the required number of Points in their QFF Program account at the time the Order is made to redeem the Product, as the case may be.

8.3 Other than for Subscription Products which must be paid for using an Accepted Payment Card, Members may only purchase Products through the Website by either redeeming Points or using an Accepted Payment Card, or a combination of both. 

8.4 For Orders made by redeeming Points, the Points redeemed for Products will be deducted from a Member’s QFF Program account at the time of Qantas Wine accepting the Order and the deduction will be reflected in the Member’s QFF Program activity statement.

8.5 If a Member has stored the details of an Accepted Payment Card in their Member Account, the Member may update or delete these details by logging into their Member Account on the Website or by contacting the Service Centre. 

9. Coupon Codes and Special Offers 

9.1 Qantas Wine and Qantas may send Coupon Codes or Special Offers to Members through standard promotional channels to which the Member is subscribed. Coupon Codes and Special Offers are not transferable and a limit of use may apply, as set out in the applicable terms and conditions communicated to the Member. Certain Coupon Codes or Special Offers may not be used in conjunction with any other offer. Coupon Codes and Special Offers may be available to all or selected Members only from time to time.

9.2 Any terms and conditions applicable to any Coupon Code or Special Offer will be communicated to the Member. Coupon Codes and Special Offers will have an expiry date that will be advised. 

9.3 Qantas Wine may cancel or suspend an Order using a Coupon Code or Special Offers if Qantas Wine reasonably believes the use of the Coupon Code or Special Offer to be fraudulent, or otherwise in contravention of the Qantas Wine Terms or the coupon or offer terms.  This includes where a Coupon Code or Special Offer was shared through social media or otherwise provided to an individual through unauthorized channels.

10. Orders that earn Points

10.1 Members

(a) A Member may earn the specified Points (including any applicable Bonus Points), for Product purchases made by that Member using an Accepted Payment Card or by redeeming Points through the Website, or by a combination of both, for eligible Products as specified by Qantas Wine from time to time (Eligible Products).

(b) The number of Points earned (if any) for Eligible Products will be at the rate advertised on the Website at the time of purchase but will not include any delivery fees payable. If, however, any Product is listed with an incorrect number of Points that may be earned in connection with acquisition of the Product, and Qantas reasonably considers that the mistake should have been obvious to Members acting reasonably, then Qantas Wine may:

(i) credit the QFF Program account of any Member who has purchased the Product with only the correct number of Points; or

(ii) deduct from the QFF Program account of any Member who has purchased the Product the number of Points credited to the account in error.

(c) If Points are earned on Eligible Products that have been discounted, the number of Points earned will be on the discounted price not on the original price of the respective Eligible Products. 

(d) Members will not be entitled to Points in relation to any Eligible Products that are cancelled, refunded or returned.

(e) Qantas may cancel or deduct the number of Points that were awarded in relation to cancelled, refunded or returned products or services including in relation to any Bonus Points earned on purchases where such Eligible Products are cancelled, refunded or returned.

(f) Points may take up to six weeks from the date an Order is accepted to be credited to a Member’s QFF Program account.

(g) Qantas may:

(i) refuse to award Points or Bonus Points; or

(ii) cancel or deduct the number of Points or Bonus Points that were awarded,

if Qantas Wine reasonably believes the applicable transaction to be fraudulent, not made in good faith, or that the awarding of Points or Bonus Points is otherwise in contravention of these Qantas Wine Terms.

10.2 Qantas Business Rewards

(a) Certain Members who are associated with a Qantas Business Rewards account as specified on the Website at the time of purchase, may earn Points in the Qantas Business Rewards when they make an Eligible Purchase, Eligibility criteria may apply and will be published on the Website.

(b) A Member may earn Points in their Qantas Business Rewards account, including any applicable Bonus Points, only for successful payments made by that Member using an Accepted Payment Card.

(c) The number of Points earned (if any) for Eligible Products will be at the rate advertised on the Website at the time of purchase but will not include any delivery fees payable. If Points are earned on Eligible Products that have been discounted as part of a Special Offer, the number of Points earned will be on the discounted price not on the original price of the respective Eligible Products.

(d) Points will not be awarded in relation to any Eligible Products that are cancelled, refunded or returned.

(e) Qantas may cancel or deduct the number of Points that were awarded in relation to cancelled, refunded or returned products or services including in relation to any Bonus Points earned on purchases where such Eligible Products are cancelled, refunded or returned.

(f) Points may take up to six weeks from the date an Order is accepted to be credited to a Member’s Qantas Business Rewards program account.

(g) Qantas may refuse to award Points or Bonus Points, or cancel or deduct the number of Points or Bonus Points that were awarded, where Qantas Wine reasonably believes the applicable transaction to be fraudulent, or that the awarding of Points or Bonus Points is otherwise in contravention of these Qantas Wine Terms.

(h) In addition to these Qantas Wine Terms, the Qantas Business Rewards terms and conditions apply to any purchase made with a Qantas Business Rewards membership. 11. Redemption of Points through the Website

11.1 In addition to the Points required to be redeemed for any Product, Members must pay all identified surcharges, charges, fees, GST and taxes.

11.2 Points cannot be converted to or exchanged for money.

11.3 There is no fixed relationship between the cash price charged by Qantas Wine for the payment of Products or Event Tickets and the Points required to redeem these items through the Website. Qantas Wine does not give any warranty or make any representation in relation to the underlying value of any Benefits or Products.

11.4 Members must direct any enquiries regarding discrepancies in Points redeemed for Benefits or Products to the Service Centre within six months of the date of the relevant transaction.

12. Delivery

12.1 Qantas Wine will only deliver Products to addresses within Australia. Members are responsible for ensuring that the address details provided are correct and up to date, and Qantas Wine is not liable for any loss to the Member due to incorrect or out of date address details. 

12.2 Qantas Wine will deliver all Orders free of charge to Premium Members within Australia. Delivery fees for all other Orders will be at the rates set out below. Qantas Wine will use reasonable endeavours to deliver Orders in the timeframes set out below, other than for Subscription Products for which the Member will be notified of an approximate date for each periodic delivery in advance of that delivery being dispatched.

(a) Location: Metro NSW, VIC & QLD $9.90 (or 1,722 Points) delivery fee per order, 1-4 business days delivery time

(b) Location: Metro SA, $9.90 (or 1,722 Points) delivery fee per order, 4-8 business days delivery time

(c) Location: Regional NSW, VIC, SA, QLD & ACT, $14.90 (or 2,591 Points) delivery fee per order, 3-10 business days delivery time

(d) Location: Country NSW, VIC, SA, QLD & ACT, $19.90 (or 3,461 Points) delivery fee per order, 3-10 business days delivery time

(e) Location: WA, NT, TAS, $19.90 (or 3,461 Points) delivery fee per order, 3-10 business days delivery time

The delivery timeframes are from dispatch. Orders placed before 11am will be dispatched the next business day.

12.3 Members acknowledge that the delivery timeframes set out above are estimates only, and that in some cases, deliveries may take longer than the estimated timeframes (for example, during peak periods).  To the extent permitted by law, Qantas Wine accepts no liability for any late delivery.

12.4 If Qantas Wine becomes aware that an Order has not been delivered within a reasonable time from when it was placed (as determined by Qantas Wine, acting reasonably), Qantas Wine will investigate and use reasonable endeavours to address the cause of the delay, and provide all necessary updates to the Member where practicable. 

12.5 All deliveries of Products will be performed by a Supplier on behalf of Qantas Wine, including but not limited to Australia Post. The terms and conditions of the relevant delivery Supplier will also apply to the delivery.

12.6 Qantas will not process deliveries to certain locations in the Northern Territory, Queensland, South Australia or Western Australia which may prohibit or restrict the possession or transportation of alcohol. 12.7 Delivery occurs when:

(a) possession of the Products passes to a person over the age of 18 at the delivery address specified in the Order; or

(b) if the delivery Supplier is unable to deliver the Products in accordance with the instructions in the applicable Order, the Products are delivered to the nearest Post Office and a delivery note is left at the delivery address. 

12.8 If a Member has instructed Qantas Wine to leave the Products unattended at the delivery address, the applicable delivery Supplier may, in its discretion, refuse to leave Products unattended if it does not consider the delivery location to be secure or otherwise appropriate.

12.9 If the delivery Supplier is unable on the first attempt to deliver the Products to the specified delivery address, including where the applicable delivery Supplier determines that it is unable to safely deliver the Products, the Supplier will deliver the Products to the nearest Post Office and notify the Member. Qantas Wine reserves the right to charge additional handling costs and freight charges if alternate delivery instructions are required.

12.10 Liquor Products will not be delivered if doing so may make Qantas Wine or the delivery Supplier liable for any breach of liquor legislation including, but not limited to, the Liquor Act 2007 (NSW).  This includes where the person accepting delivery of the order appears to be: 

(a) intoxicated or affected by alcohol or a prohibited substance; or

(b) under the age of 18 years; or

(c) is unable to provide a current and valid recognised proof of age identification; or

(d) accepting the order on behalf of a minor; or a person who is otherwise considered inappropriate to receive the order.

12.11 If there is any doubt about whether delivering the liquor Products may make Qantas Wine or the delivery Supplier liable for a breach of liquor legislation including, but not limited to, the Liquor Act 2007 (NSW), the Products will not be delivered and clause 12.7 will apply. 

12.12 Qantas Wine is not responsible for any Losses related to deliveries being made to incorrect or incomplete addresses provided by Members either directly at the time of making an Order or due to a failure by the Member to specify the current and correct delivery address in his or her Member Account. In such circumstances, the Member assumes responsibility for the entire purchase and, if the delivery is refused or unable to be completed by the applicable Supplier, then additional handling costs and freight charges will be applied to a request for re-delivery.

13. Title and Risk

13.1 With the exception of delivery occurring in accordance with clause 12.7(b), title and risk in all Products passes to the Member on delivery.

13.2 In respect of Products delivered in accordance with clause 12.5(b):

(a) risk passes to the Member at the time of delivery; and

(b) title passes to the Member at the time the Products are collected from the Post Office by the Member or nominated individual on behalf of the Member.

14. Warranty

Qantas Wine excludes all implied terms (other than the Non Excludable Terms) in relation to the supply of the Products. Except as set out in these Qantas Wine Terms, Qantas Wine makes no warranties or representations in relation to the Products.

15. Product returns

15.1 Qantas Wine will accept Product returns for a change of mind (Change of Mind Return) or where items were damaged or faulty upon delivery (through no fault of the Member) (Damaged Goods Return), provided that the Member lodges a return request through our Returns Portal within 30 days of receipt of the Product to request and authorise the return. Returns will only be accepted if the Member has a sufficient Points balance to allow for the deduction from their account of any Points that were awarded in connection with the Order being returned. Once your request is assessed and approved, you will get a confirmation email with returns instructions and shipping guidelines.

15.2 A Change of Mind Return will only be permitted if the Product is unopened and returned to Qantas Wine in the condition in which it was received by the Member. In the case of a Change of Mind Return:

(a) Qantas Wine may (but is not obliged to) provide the Member with return shipping free of charge.  Otherwise, the Member will be responsible for the return shipping; and 

(b) Qantas Wine will provide the Member with a full refund of the purchase price (excluding any delivery charges that were paid on the order). 

15.3 In the case of a Damaged Goods Return:

(a) Qantas Wine will provide the Member with return shipping free of charge; and

(b) Qantas Wine will provide the Member with the option of either a full refund of the purchase price (including any delivery charges that were paid on the order) or a like-for-like replacement of the Product, where available. 

15.4 Products will not be processed for replacement or refund of either money or Points unless prior authorisation for return by the Service Centre is provided to the Member. The Service Centre will authorise the return of a Product where it is obliged to do so under the Non Excludable Terms and otherwise where it is satisfied that the Member is entitled to an replacement or refund under this clause 15.

15.5 All Products authorised for return by the Service Centre must be returned to the return location specified by the Service Centre in the condition in which they were received and in their original packaging (or, where it is not practicable to use the original packaging, in other packaging reasonably acceptable to Qantas Wine). 

15.6 Refunds will be processed only after receipt and inspection of the returned Product and receipt of all Points awarded in connection with the returned Product. If a refund is processed by Qantas Wine, Qantas Wine and Qantas will:

(a) refund the amount paid for the Product by the Member by either crediting the Member’s QFF Program account for the Points redeemed, or crediting the Accepted Payment Card used, or both, as the case may be; and

(b) reverse any credit of Points (including Bonus Points) credited to the Member’s QFF Program account for the Order.

15.7 If a replacement Product is requested and authorised by Qantas Wine, instead of a refund, Qantas Wine will dispatch the replacement Product at no further cost to the Member.

16. QFF Terms

The QFF Terms apply to QFF Membership including the earning, retention and redemption of Points by Members, including all Points earned or redeemed for Products, Events, Event Tickets or Premium Membership in accordance with these Qantas Wine Terms.

17. Changes to the Qantas Wine Terms

Qantas Wine will notify Members of any material changes to these Qantas Wine Terms by publishing the changes on the Website. Where any change to these Qantas Wine Terms will be materially adverse to Members, as reasonably determined by Qantas Wine, Qantas Wine will provide reasonable prior notice of the change where practicable.

18. Customer Obligations

18.1 A Member must not:

(a) act in any way which breaches these Qantas Wine Terms;

(b) abuse or misuse any Benefits or Coupon Codes or Special Offers, Products, services (including Product Returns) or arrangements accorded to the Member;

(c) during the course of engaging with Qantas Wine or Qantas or as a result of using the Website:

(i) engage in illegal, dishonest or fraudulent activities;

(ii) supply or attempt to supply false or misleading information, or make a misrepresentation to Qantas Wine or Qantas; 

(iii) act in a hostile, abusive or aggressive way towards Qantas Wine or Qantas staff; or

(d) exploit (or attempt to exploit) any obvious errors on the Website (including but not limited to technical glitches and the type of errors specified in clauses 7.6 and 10.1(b) to the detriment of any Qantas Group Company or any other person.

18.2 If Qantas Wine has reasonable grounds to suspect a Member has committed a material breach of these Qantas Wine Terms, or has failed to pay any money due to any Qantas Group Company, whether intentionally or otherwise, then Qantas Wine and Qantas may:

(a) cancel any Order and, except to the extent the Member owes any money to Qantas:

(i) refund the amount paid for the Product(s) by the Member by either crediting that Member’s QFF Program account for the Points redeemed, or crediting the Accepted Payment Card used, or both, as the case may be; and

(ii) deduct the number of Points credited to the Member’s QFF Program account in connection with the purchase of the Product(s);

(b) refuse to supply any Product to the Member; or

(c) cancel any Premium Membership held by that Member.

19. Events

19.1 Event details

(a) From time to time Qantas Wine may advertise Events (or other events) on the Website for Members to purchase tickets to attend. Some Events may be exclusive to Premium Members.

(b) Qantas Wine may at any time, without advance notice to Members, withdraw, limit, modify, cancel or increase the availability or cost of Event Tickets. Event Tickets are strictly limited in number, may be offered for a limited time and are offered while stocks last.

19.2 Purchasing Event Tickets using Accepted Payment Card

(a) Members may purchase Event Tickets for themselves and their guests through the Website either by redeeming Points, or by making a payment using an Accepted Payment Card. A Member cannot purchase Event Tickets using a combination of Points and payment by an Accepted Payment Card.

(b) For Premium Member exclusive Events, Qantas Wine will only accept Orders for Event Tickets from current Premium Members whose Premium Membership has not been suspended or cancelled.

(c) Additional terms and conditions apply to all Event Tickets and Event Ticket purchases and will be disclosed to the Member at the time of purchase. By purchasing an Event Ticket, the  Member agrees to comply with those additional terms and conditions.

19.3 Purchasing Event Tickets by redeeming Points

If a Member wishes to purchase Event Tickets by redeeming Points, the Member must have the required number of Points to redeem the selected Event Tickets in their QFF Program account at the time of purchase. Points redeemed for Event Tickets will be deducted from a Member’s QFF Program account at the time of purchase and the deduction will be reflected in the Member’s QFF Program activity statement.

19.4 Eligibility

(a) Unless otherwise expressly stated, all Event attendees must be 18 years of age or older.

(b) Points will be credited to the QFF Program account of the Member who pays for Event Tickets using an Accepted Payment Card. Points cannot be credited to the account of another QFF Member.

(c) A Member will earn Points at the rate advertised on the Website at the time the relevant transaction is made. Qantas Frequent Flyer members who are not Qantas Wine Premium members will earn 1 Qantas Point per dollar spent and Qantas Wine Premium members will earn 3 Qantas Points per dollar spent on Eligible Products and Services purchased through qantas.com/wine. Qantas Points can be earned on cash only purchases and the cash component of Points Plus Pay purchases on eligible products. The earning and redemption of Qantas Points are subject to the Qantas Frequent Flyer Terms and Conditions. Allow up to 6 weeks for Qantas Points to appear in your Qantas Frequent Flyer account.

19.5 Transfer and refund

(a) Event Tickets are transferable up to 48 hours prior to the Event, unless otherwise specified by Qantas Wine.

(b) Unless otherwise specified by Qantas Wine, Event Tickets will not be refunded unless the Event is cancelled. If an Event is cancelled, Qantas Wine will:

(i) use reasonable endeavours to notify the Member as soon as practicable via email;

(ii) refund the amount paid for the Event Tickets by the Member by either crediting the Member’s QFF Program account for the Points redeemed, or crediting the Accepted Payment Card used, to purchase the Event Tickets, as the case may be; and

(iii) deduct the number of Points credited to a Member’s QFF Program account (if any) in connection with the purchase of for the applicable Event Tickets.

19.6 Photography at Events

(a) By purchasing an Event Ticket, Members acknowledge that a photographer may be present at the relevant Event and that the Member and his or her guest (if any) may be photographed.

(b) Photographs taken at an Event are the sole property of the Qantas Group and any Qantas Group Company has the right to use, amend, crop, adapt, modify, exploit, reproduce, communicate, distribute or publish any such material publicly on the Website and any media (including banners/signage/posters, magazine, Internet, or other digital or print formats).

(c) Members consent to photographs being taken of them and their guest(s) for the purposes described in this clause 19.6 and acknowledge they will not be entitled to any monetary or other compensation for such use.

20. Material and information on the Website

20.1 Qantas Wine information

Qantas Wine will use reasonable endeavours to ensure that information included by or on behalf of Qantas Wine on the Website is complete and accurate. However, to the extent permitted by law, Qantas Wine accepts no liability for the lack of completeness or accuracy of such information.

20.2 External Sites

The Website may contain links to, or frame, websites of third parties (External Sites). Links to, or framing of, External Sites should not be construed as any endorsement, approval, recommendation or preference by Qantas Wine of the owners or operators of the External Sites, or for any information, products and services offered or referred to on the External Sites, unless the endorsement, approval, recommendation or preference is expressly indicated on the Website. Qantas Wine makes no warranty and accepts no liability in relation to material contained on External Sites.

20.3 Intellectual property

(a) The material contained on the Website is protected by copyright. A Member must not use, copy, modify, transmit, store, publish, distribute or create derivative works of the material on the Website, without obtaining the prior written consent of Qantas Wine.

(b) Trade marks (whether registered or unregistered) and logos used on the Website must not be used or modified in any way without obtaining the prior written consent of Qantas Wine.

(c) The Website and products, technology and processes contained on it may be the subject of other intellectual property rights owned by the Qantas Group, Suppliers or third parties. Members’ use of the Website must not in any way infringe the intellectual property rights of any person.

(d) A Member must not:

(i) use any device, software, routine or any other method to interfere or attempt to interfere with the proper working of the Website; or

(ii) take any action that imposes a burden or load on the Website not authorised by Qantas Wine or that is unreasonable or disproportionate to the benefits Qantas Wine obtains from that Member’s use of the Website.

21. Liability

21.1 Consumer protection legislation

(a) Qantas Wine acknowledges that the Competition and Consumer Act 2010 (Cth), the Fair Trading Act 1987 (NSW) and other equivalent legislation implies or imposes statutory guarantees, conditions or warranties into contracts for the supply of goods or services to consumers that cannot be excluded (Non Excludable Terms). Nothing in these Qantas Wine Terms (including the exclusions and limitations in this clause 21) is intended to exclude or restrict the application of Non Excludable Terms. As such, nothing in these Terms affects any rights a Member may have and which by law cannot be excluded; however, to the extent permitted by such legislation, any such liability of Qantas Wine is limited to the cost of supplying the goods or services again.

(b) Other than the Non Excludable Terms, Qantas Wine excludes all implied terms in relation to the supply of Benefits or Products.

(c) Qantas Wine excludes all liability for Consequential Loss.

21.2 Third party products

The Benefits may include the ability to acquire goods or services from third parties (Third Party Products) that are not, or on terms that are not, available to persons that are not Members. The provision of Third Party Products will be subject to the terms and conditions of the applicable third party suppliers. Qantas Wine excludes all liability in relation to Third Party Products.

21.3 Taxes and charges

(a) Members are responsible for any costs, charges, taxes, claims or other liabilities (including any applicable fringe benefits tax) arising from receipt of the Benefits or in relation to any Third Party Products.

(b) Qantas Wine recommends that Members consult their accountant or tax adviser to ensure that they understand possible tax (including fringe benefits tax) implications, if any, related to their use of this Website.

21.4 Benefit of terms

If a Supplier or any Qantas Group Company suffers or incurs Losses as a result of a Member’s breach of these Qantas Wine Terms and Qantas Wine would have been able to recover those Losses if they were suffered or incurred by Qantas Wine, then Qantas Wine will be able to recover those Losses as if those Losses were suffered or incurred by Qantas Wine.

22. Termination by Qantas Wine or Qantas

22.1 Qantas Wine may terminate or cease to operate the Qantas Wine Business and Qantas may terminate or cease to operate the QFF Program, at any time at their discretion.

22.2 Qantas Wine and Qantas will use their best endeavours to give Members as much notice of any termination referred to in clause 22.1 as is reasonably practicable in the circumstances.

23. Personal information

23.1 Each Member acknowledges that Qantas Wine and Qantas collect, use and disclose information about the Member, in order for Qantas Wine and Qantas to carry out the activities set out in these Qantas Wine Terms. The information about such use in this clause 23 should be read alongside the Qantas Privacy Policy, which contains more detailed information about how a Member’s personal information is processed and used by Qantas Wine and Qantas.  

23.2 Qantas Wine and Qantas may collect and use personal information about each Member, and may disclose such personal information to any Supplier or other person (including a Qantas Group Company, agent or contractor of Qantas Wine or Qantas or any Supplier): 

(a) to provide the products and services described in these Qantas Wine Terms;

(b) for research, marketing, product development and planning purposes, including to provide the Members with updates and offers (if the Member has chosen to receive these);

(c) to operate and facilitate participation in the QFF Program, including to award Points, track benefit accrual and redemption activities and to confirm a Member’s eligibility for, and providing any products and services associated with the Qantas Wine Terms; and

(d) for the purposes of any third party providing services to any Qantas Group Company, in connection with the administration of the Qantas Wine Business or the QFF Program.

23.3 It is a condition of Premium Membership that each Premium Member consents and authorises Qantas Wine and Qantas to collect and use the information collected by Qantas Wine or Qantas in relation to that Premium Member, and disclose it to any Supplier and any other person (including any Qantas Group Company agent or contractor of Qantas Wine or Qantas or any Supplier), for the purposes of:

(a) Qantas Group Company providing services (directly or through a Supplier) in connection with the Qantas Wine Business or the Premium Membership, including the supply of Benefits or Products or the awarding of Points, or the QFF Program;

(b) Qantas Group Company improving Qantas customer service, including by means of research, marketing, product development and planning;

(c) Qantas Wine and Qantas marketing their Products or the products or services of third parties; and

(d) any third party providing services to any Qantas Group Company or Premium Members in connection with the administration of the Qantas Wine Business or the QFF Program.

23.4 If the Member does not provide all or any part of the requested information, the services and products provided to that Member by Qantas Wine and Qantas, may be affected. 

23.5 Qantas Wine, Qantas and any Supplier will not otherwise disclose a Member’s personal information without that party’s consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity. 

23.6 Qantas Wine and Qantas will provide a Member with access to and the ability to correct their personal information held by Qantas Wine or Qantas on request by that Member. 

23.7 Further information on how Qantas handles personal information is contained in the Qantas Privacy Policy. Members can contact us as set out in that policy or by writing to Group Privacy Officer, Qantas Customer Care at 10 Bourke Road, Mascot, NSW, 2020. Only the Member named on the account will be entitled to access their Membership information.

23.8 This clause 23 survives the termination of these Qantas Wine Terms and the termination or suspension of the Qantas Wine Business.

24. General

24.1 The Website may be used for a Member’s personal non-commercial use only and not for any commercial use. Benefits, including Event Tickets and Products (as applicable), may not be acquired for commercial use.

24.2 If part or all of these Qantas Wine Terms are illegal, invalid or unenforceable then they will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions will continue to apply. 

24.3 The Qantas Wine Terms are governed by and will be construed in accordance with the laws applicable in New South Wales. Any action or other legal process in connection with these terms must be instituted and carried on only in the appropriate court in Australia.

24.4 Qantas Wine recommends that alcohol only be consumed in moderation. Liquor Act 2007 (NSW): No alcohol can be sold or supplied to anyone under 18. It’s against the law. Licence Number: NSW LIQP770016736 NT IRL0201, SA 57900154.
